General terms & Conditions
The terms and conditions of Jennifer Gruenauer (“me” “we,” “our,” or “us” “Photographer”) were last updated on February 3, 2025 and applies to citizens and legal permanent residents of the European Economic Area and Switzerland.
1. Scope of Application
These Terms and Conditions apply to all contracts, offers, and services provided by the Photographer, unless otherwise agreed in writing. By booking a session or service, the client agrees to these terms.
2. Services and Agreement
A booking is considered confirmed upon receipt of a signed contract and payment of the agreed deposit. The scope of services, including photography duration, location, and deliverables, will be outlined in the contract.
3. Payment Terms
3.1. A non-refundable deposit is required to secure a booking. The remaining balance must be paid by the agreed due date.
3.2. If payment deadlines are not met, the Photographer reserves the right to withhold services or cancel the booking.
3.3. Additional costs (e.g., travel expenses, accommodation, permits) will be agreed upon in advance and must be covered by the client.
3.4. Online payments can be made via WISE, Paypal or bank transfer.
4. Cancellation and Rescheduling
4.1. If the client cancels a booking, the deposit remains non-refundable. Cancellation fees may apply depending on the notice period stated in the contract.
4.2. Rescheduling due to unforeseen circumstances (e.g., illness, force majeure) will be accommodated where possible, subject to availability.
5. Image Rights and Usage
5.1. The Photographer retains copyright to all images and grants the client personal usage rights as outlined in the agreement.
5.2. The client may use the images for personal purposes (e.g., prints, social media with credit). Commercial use requires prior written consent and payment.
5.3. The Photographer may use images for portfolio, website, and promotional purposes if agreed upon in the contract. Otherwise the photos remain private and will not be used comercially in any way.
6. Liability and Warranty
6.1. The Photographer is not liable for circumstances beyond their control, such as weather, unforeseen location restrictions, or client delays.
6.2. If a technical failure prevents image delivery, the Photographer will offer a reshoot or refund the affected portion of the fee.
6.3. The client is responsible for their own safety and belongings during the session.
7. Image Editing and Delivery
7.1. The Photographer will edit and deliver images in their signature style. Raw files are not provided.
7.2. Editing requests beyond standard retouching may incur additional charges.
7.3. Delivery timelines will be specified in the contract but may be subject to reasonable delays due to workload or unforeseen events (e.g. child sick care).
8. Governing Law
These Terms and Conditions are governed by the laws of Austria. Any disputes arising from this agreement will be settled in the competent courts of Austria.
9. Final Provisions
If any provision of these Terms and Conditions is found to be invalid, the remaining provisions shall remain in effect. Changes and amendments must be made in writing.
